Zoning Commission MCA 76-2-301

The Zoning Commission was created for the purpose of promoting health, safety, morals, or the general welfare of the community, the city or town council or another legislative body of cities and incorporated towns is hereby empowered to regulate and restrict the height, number of stories, and size of buildings and other structures; the percentage of lot that may be occupied; the size of yards, courts, and other open spaces; the density of population; and the location and use of buildings, structures, and land for trade, industry, residence, or other purposes.

In order to avail itself of the powers conferred by this part, except (MCA 76-2-306), the city or town council or other legislative body shall appoint a commission, to be known as the zoning commission, to recommend the boundaries of the various original districts and appropriate regulations to be enforced therein (MCA 76-2-307).

Membership for the City Zoning Commission as provided by statute shall consist of five (5) members.

The Livingston City Commission is authorized for the enforcement of applicable Montana Codes, and of any regulation or ordinance made thereunder. In case any building or structure is erected, constructed, reconstructed, altered, repaired, converted, or maintained or any building, structure, or land is used in violation of this part or of any ordinance or other regulation made under authority conferred hereby, the proper local authorities of the municipality, in addition to other remedies, may institute any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, repair conversion, maintenance, or use; to restrain, correct, or abate such violation; to prevent the occupancy of such building, structure, or land; or to prevent any illegal act, conduct, business, or use in or about such premises (MCA 76-3-308).

Meetings are held on the 2nd Tuesday of every month,  at 5:30 p.m. in the Community Room.
